Brian was charged with fraudulently obtaining a certificate for admission as an Advocate.
He was arrested last week and spent the Friday holiday and weekend by extension, in the cell.
He comes out to sanctify himself and defend his course through a video clip, before his arrest.

Brian Njagi has been granted a free bail of 200,000 with his case set to be mentioned on 7th November this year.
Brian Njagi Mwenda stormed the headline after the Law Society of Kenya raised a flag about his qualifications.
The ambitious young impersonating lawyer now seems that he will be having trouble pursuing law as a profession in the near future whether the case against him becomes null.

Brian on the other to his defense has revealed why he chose to become a fake lawyer after studying degree in criminology and security studies.

Citing his short speech clip which he released for the public, he said that he faked to be a lawyer due to a lack of jobs, his born talent, confidence, and courage; he expounds on courage saying he has won over 26 cases in  High Court, his dream come true without university papers, his cleverness and wisdom, allowing people with capabilities to perform duties even without academic papers. These are the reasons Brian gave while defending his alleged illegal action.

A Law Student from a public University during our discussion, though requested her identity to be concealed, narrates the plight of Brian Njagi, after his sourly turned game of masquerade.

According to her, the Law Society of Kenya won't let the matter go easy, due to the strict rule to be adhered to within the institution, "well LSK won't let him get away with it, that's for sure," she says while smiling. She likened the LSK's rules to that of Medicine which she says too is a noble profession. 

The Law Society of Kenya is a constitutionalized institution that is responsible for approving law graduates to be eligible to be behind bars and start practicing their profession officially. Every lawyer or advocate must therefore pass through the Law Society of Kenya (LSK) for approval. 

Brian having therefore claimed to be an advocate and has practiced his advocacy illegally bearing the title, no any day will he be allowed to practice law by the Law Society of Kenya, "LSK has often found means to regulate the number of people who can practice it, the entry points, the bar exams would explain it well," she says. "It (Law) has been zealously protected," she added.
 As she was defending LSK's image, she  reiterated that media is also is giving misappropriated facts to the public, "the story sold by the Media concerning Brian, of course, is a lie," she claims, arguing that Mr. Brian just started practicing recently on M & M LLP (Michieka & Mwenda Advocates) and has never concluded any matter in court and that the 26 cases are a mock which he practiced in small claims court, "he had just started practicing recently on M & M LLP (Michieka & Mwenda Advocates) so he has never concluded a matter in court." According to her, Brian never made an appearance in court filling a matter a the registry, and he only appeared on record during the mention.

She dismisses the COTU Secretary General, Francis Atwoli, and former Nairobi Governor for supporting Mr. Brian Njagi, claiming that whether Brian will be found guilty or not he won't be allowed back to train for his barrister, " Should he be found guilty or not, though it's highly unlikely for him to be found not guilty..., his fate with the law is a sealed one, never ever will he be allowed to enter into practice again." she narrates, "So the story by Mike Sonko and the COTU fellow(Francis Atwoli) for paying him fees at law school and KSL are nonsensical stories." she added.

When asked about the fate of Brian coming back to bars by either means, she reiterated that it will never happen as the Law Society of Kenya will never allow, "that will never happen. LSK will never, if it allows it will be like citing death to a guillotine." she said.

Brian Njagi was arrested on 16th October and was charged with fraudulent certificate for admission to the legal profession as an Advocate, he was remanded over the weekend and was released on Monday on a cash bail of Ksh. 200000. He pleaded not guilty of the charges against him 
His plight still lies with the court as his case is set to be mentioned on date 7 of November. Even though the prosecution and the Law Society of Kenya were against the cash bail.
